Lawyers Want Crime Stoppers Info In Carson Case, Atwater Trial Set For 2009

DURHAM, N.C. -

Lawyers for two men accused of killing University of North Carolina at Chapel Hill student body president Eve Carson want all Crime Stoppers information on the case.

Lawyers for 22-year-old Demario Atwater and 18-year-old Laurence Lovette want all the tips the private organization received.

The 22-year-old Athens, Ga., woman was found dead on a Chapel Hill street in March.

Police decide which information from Crime Stoppers is put in the case file, which is shared with defense attorneys.

Defense attorneys want to see what tips police did not pursue. A Crime Stoppers call led authorities to Atwater.

Chapel Hill Police Chief Brian Curran said he's concerned the request could discourage people from calling Crime Stoppers.

Meanwhile, a federal judge set a November 2009 trial date for Atwater, who appeared in U.S. District Court in Greensboro Tuesday on several charges, including carjacking resulting in
death. He could face the death penalty.

The 22-year-old is facing state murder and kidnapping charges in Orange County. He faces the death penalty, though a capital murder case there hasn't resulted in an execution in 60 years.

Co-defendant Laurence Lovette isn't eligible for the death penalty because he was 17 at the time of Carson's death.
